Good afternoon SipNOC 2024 Attendees,
I know I have been keeping you in “dramatic suspense” for a number of months since I last checked in on the infamous draft Eighth Report Order in CG Docket No. 17-59 that was on the FCC’s Sep. 26, 2024, open meeting agenda but then suddenly got pulled and was put on circulation. It seemed to be “lost in circulation space”, but then on Feb. 6, 2025, a revised, shortened version of the draft order appeared and was proposed to be on the FCC’s Feb. 27, 2025, open FCC meeting agenda (text messaging provisions in the earlier version of the draft order were removed). I was unsure if the order ever see the light of day, but it did.
All that said, by now and as you may have already heard, the FCC finally adopted its Eighth Report and Order in CG Docket No. 17-59 (FCC 25-15 <https://docs.fcc.gov/public/attachments/FCC-25-15A1.pdf> ) on call blocking during its Feb. 27, 2025, Open Meeting.
Below is summary of the FCC’s key decisions and holdings it adopted in this Eighth Report and Order:
* Expands the requirement to block calls based on a reasonable Do Not Originate (“DNO”) list to include All U.S.-based Providers “in the Call Path.” Below are key FCC holdings concerning the DNO list itself:
* The FCC does not “mandate the use of a specific list, but allowed providers to use any DNO list so long as the list is reasonable.” The FCC also “decline[d] to designate the Industry Traceback Group’s list as presumptively reasonable.”
* The FCC also found that “the burden of requiring all providers, including smaller providers, to use an expansive DNO list is unnecessary at this time,” especially “when all other providers in the call path must block” and that “some providers will use or already use these more expansive lists, and a single call will often pass through several networks on its path to the recipient.” Nevertheless, the FCC “recommend[s] that providers, when technically feasible, use a more comprehensive list to safeguard even more consumers.”
* The DNO “list may include only invalid, unallocated, and unused numbers, as well as numbers for which the subscriber has requested blocking.”
* “[T]o be considered reasonable, [the DNO] list may include only the above-referenced categories of numbers and need not include all possible covered numbers. This is particularly true for unused numbers, which may be difficult for some providers to identify in some cases.”
* The FCC may, however, “deem unreasonable a [DNO] list so limited in scope that it leaves out obvious numbers that could be included with little effort.”
* “Providers must constantly update DNO lists, especially if they include unused numbers that could go into use at any time, and there is not currently a standardized way to ensure that these updates would happen in real time for all providers.”
* The FCC also maintains its “previous approach, which allows providers to exercise discretion as to what numbers they include on their [DNO] lists, so long as the list includes, at a minimum: 1) ‘any inbound-only government numbers where the government entity has requested the number be included;’ and 2) ‘private inbound only numbers that have been used in imposter scams, when a request is made by the private entity assigned such a number.’ Providers may, of course, include inbound-only numbers that have not been used in imposter scams if they are capable of doing so.”
* This new DNO blocking requirement that applies to all providers in the call path is effective 90 days after publication of a notice of Office of Management and Budget (OMB) approval in the Federal Register.
* Establishes SIP code 603+ as the exclusive code to notify callers when calls on IP networks are blocked based on reasonable analytics to better correct erroneous blocking.
* This requirement only applies when providers block calls based on analytics; the FCC does “not require providers to provide immediate notification when blocking based on a DNO list, pursuant to Commission notification if not based on analytics, or at the request of a customer without the use of analytics.”
* All providers are “required to perform necessary software upgrades to ensure the codes we require for such notification are appropriately mapped.”
* Providers must ensure that “calls that transit over Time Division Multiplexing (“TDM”) and IP networks return an appropriate code when calls are blocked based on an analytics program, and the correct ISUP code for this purpose remains 21. The FCC directs “voice service providers to cease using the standard version of SIP code 603, or SIP codes 607 or 608, for this purpose.”
* FCC requires “providers to implement SIP code 603+ no later than 12 months from publication of this Order in the Federal Register.” The FCC explained that it directs “providers to cease using SIP codes 603, 607, and 608 when calls are blocked using analytics once they have implemented 603+ and in no instance later than 12 months from publication of this Order in the Federal Register.”
* “Providers may continue to use SIP code 603 where otherwise appropriate, but not for analytics-based blocking except when an intermediate or terminating providers receive ISUP code 21 and cannot reasonably determine whether SIP code 603 or 603+ is appropriate. SIP code 607 may be used for its intended purpose: to indicate that a call was blocked at the subscriber’s direction without the use of analytics.”
Apart from adopting the above rules, the FCC expressly “decline[d] to require the display of caller name information when a provider chooses to display an indication that caller ID has been authenticated.” The FCC explained that “[a]lthough we do not adopt such a mandate, we urge providers to continue to develop next-generation tools, such as Rich Call Data (“RCD”) and branded calling solutions, to ensure that consumers receive this information and welcome any updates the industry has on its progress.” The FCC noted that it “may consider a mandate in the future, particularly if the timely deployment of such valuable tools does not occur without Commission intervention.”
I had a good feeling this order would eventually make it over the finish line and ultimately have its day, but was unsure when.

I hope all is well. I thought I would follow up on my email below and share some Halloween goodies with you.
In particular, while the FCC still has the draft Eighth Report and Order <https://www.fcc.gov/items-on-circulation> on circulation (i.e., it has yet to be adopted), the Chairwoman announced that the FCC’s Nov. 21, 2024 open meeting will include an order that addresses third-party authentication, which has been a heated topic.
Here’s the FCC’s draft order <https://docs.fcc.gov/public/attachments/DOC-407144A1.pdf> and summary of it is pasted below (with emphases added):
What the Report and Order Would Do:
* Define “third-party authentication” to provide a clear scope of the third-party authentication practices authorized and prohibited by the new rules.
* Authorize providers with a STIR/SHAKEN implementation obligation to engage third parties to perform the technological act of digitally “signing” calls consistent with the requirements of the STIR/SHAKEN technical standards, subject to two conditions:
* (1) The provider with the implementation obligation itself makes the critical “attestation level” decisions for authenticating caller ID information associated with its calls; and
* (2) All calls are signed using the certificate of the provider with the implementation obligation—not the certificate of a third party.
* Explicitly require all providers with an implementation obligation to obtain a Service Provider Code (SPC) token from the Policy Administrator and present that token to a STIR/SHAKEN Certificate Authority to obtain a digital certificate.
* Require any provider certifying to partial or complete STIR/SHAKEN implementation in the Robocall Mitigation Database to have obtained an SPC token and digital certificate and sign all its calls with that certificate, either themselves or when working with a third party to perform the technological act of signing calls.
* Adopt recordkeeping requirements for third-party authentication arrangements to monitor compliance with and enforce the Commission’s rules.
Interested stakeholders looking to have written or oral ex partes with the FCC on the draft order need to do so by Nov. 14, 2024.

Bear in mind, the FCC’s language in a draft/proposed order is fairly fluid, as it is basically a “courtesy view” of what the FCC is entertaining (just for the FCC to make sure it got it right - from its perspective of course).
Note that the FCC’s release of draft/proposed orders on an FCC open meeting agenda only started happening during the Pia regime.
At this point, the comment cycle has already occurred for the FCC to rule on this NPRM.
Until the FCC adopts a draft/proposed order that it previously shared with the public, any language in the draft/proposed order is subject to change, which is why you will see a slew of ex partes on the item advocating change or not to the draft/proposed order before the sunshine period, which is the one-week quiet period just before the open meeting.

FYI – Quick update on the above, I was told the Chairwoman’s Office has stated publicly that the item will move to Circulation. I have yet to see it on the FCC’s “Items on Circulation” list though. See https://www.fcc.gov/items-on-circulation. Perhaps we will see it appear in the next day or so.

This afternoon the FCC deleted <https://docs.fcc.gov/public/attachments/DOC-405764A1.pdf> the draft/proposed Eighth Report and Order <https://docs.fcc.gov/public/attachments/DOC-405219A1.pdf> (which was the subject of a fair amount of discussion during SIPNOC 2024 last week) from the FCC’s Open Meeting on Sep. 26.
At this point, it is unclear if this item was adopted on circulation or if the FCC hit the pause button given the various ex partes filed last week.
I suspect we should know one way or another in short order.
