RFC3312 defines the behavior.

It specifies that if the message has preconditions in an offer then it 
MUST have a Supported or Require 'precondition'.

But there is no converse requirement that if you have 'precondition' in 
Supported or Require then you must have SDP using preconditions.

Just read section 11 of RFC3312.
