The way that T.38 works is A calls B and negotiates an audio codec. then A sends fax tones over RTP. once B detects the fax tones it sends a Re-invite with T38. so wouldnt make sense for A to send re-invite to B with T38 because at this point its not clear even if B supports t38 or if it is setup properly to process FAX calls.
